Guardianship
When a loved on no longer can take care of themselves, the law steps in to help them. Guardianship is a legal proceeding designed to supervise and protect them. The Texas Probate Code defines an “incapacitated person” as an adult individual who, because of a physical or mental condition, is substantially unable to:
- Provide food, clothing, or shelter for himself or herself;
- Care for the individual’s physical health; or
- Manage the individual’s financial affairs.
The definition also includes a minor or a person who must have a guardian appointed to receive funds due to the person from any governmental source. The “ward” is the person who requires help. The “guardian” is the person appointed by the court to help the ward manage his financial affairs and care for himself or herself.
